Cabinet approves Minister Mpahlwa’s recommendation for appointment of Competition Tribunal members

Cabinet has approved the recommendation made by the Minister of Trade and Industry (the dti) Mandisi Mpahlwa, for President Kgalema Motlanthe to appoint Mr Norman Manoim, as the new Chairperson, and Advocate Mbuyiseli Madlanga as the new Deputy Chairperson of the Competition Tribunal. Manoim will be replacing Mr Dave Lewies, while Madlanga will replace Advocate Marumo Moerane, when their terms expire in July 2009.
According to Ms Zodwa Ntuli, Deputy Director-General for Consumer and Corporate Regulation, Cabinet approval includes the appointment of three new members and the re-appointment of three current members of the Competition Tribunal, These are Yasmin Ms Tayob Carrim and Mr Andreas Wessels, who will serve as full-time members, Ms Moira Mokuena, Professor Merle Holden, Mr Takalani Madima and Ms Andiswa Ndoni, who will serve as part time members of the tribunal.
The Competition Tribunal adjudicates competition matters in accordance with the Competition Act, No. 89 of 1998. The tribunal is subject to the Constitution and the law, and acts independently. The Tribunal may hear matters relating to mergers and acquisitions, complaints regarding cartels and other anti-competitive business practices, and may impose remedies, including the ordering of fines to be paid by transgressors or conditions to be adhered to as deemed necessary.
“The appointment of the Competition Tribunal members prior to expiry of their term in July 2009 will greatly assist in facilitating a proper hand over to the new leadership. The tribunal plays a key role in competition regulation, and we are confident that this good work will continue under the leadership that has been approved for appointment by Cabinet,” said Ntuli.
