TO ALL HEADS OF NATIONAL DEPARTMENTS, PROVINCIAL ADMINISTRATIONS, PROVINCIAL DEPARTMENTS AND ORGANISATIONAL COMPONENTS

Amendment of the Public Service Regulations, 2001 to extend the Disclosure of Financial Interests to All Members of the Senior Management Service in the Public Service and to effect Certain Corrections and to further provide for the Format of the Annual Report

  1. The Minister for the Public Service and Administration approved that in terms of section 41(1)(d) of the Public Service Act, 1994, Chapter 3 of the Public Service Regulations, 2001 be amended to prescribe that all members of the senior management service (SMS) disclose their financial interests. The relevant amendment to the Public Service Regulations has already been published in Government Gazette No 7068 of 25 May 2001, a copy of which is attached for your information.

  2. In accordance with the amended Chapter 3 that became operational with effect from 1 May 2001 all members of the SMS in a national department, organisational component, provincial administration and provincial department are to disclose their financial interests.

  3. To ensure swift implementation of the disclosure of financial interests of senior managers, I wish to bring the following to your attention:

    1. In accordance with regulation C.1 (Chapter 3) every designated employee must be requested to disclose her/his registrable interests in respect of the period 1 April 2000 to 31 March 2001 by not later than 30 April 2001 and thereafter yearly.

    2. As a transitional arrangement, C2 and C4 of the Regulations have been amended to the effect that any person who became a designated employee from 1 May 2001 only, namely senior managers at director and chief director level, shall make the disclosure in respect of the above-mentioned period not later than 30 June 2001 to the relevant executing authority whereafter the executing authority must submit to the Public Service Commission a copy of the form not later than 31 July 2001.

    3. The form to be used in this regard is attached hereto (no other forms must be used). An electronic copy of the form is also available on line at: http://www.info.gov.za/forms/index.html. The form must be signed by the Executing Authority and Commissioner of Oaths/Justice of the Peace after all requested items have been completed.

    4. Any manager who does not comply with regulation C (Chapter 3) will be guilty of misconduct.

    5. The original completed form must be submitted to the relevant executing authority who on her/his turn must submit a copy thereof to the Public Service Commission.

  4. It would be appreciated if you could oversee the speedy implementation of the amended Chapter 3 and ensure the relevant deadlines are strictly adhered to.

  5. In view of sound management, it is of vital importance for Executing Authorities to ensure that all items on the forms are completed/signed and in instances where possible investigation or follow up actions are necessary, it be brought to the attention of the Public Service Commission or further steps be taken to address the matter.

  7. Please note that the Notice also contains the following amendments to the Regulations:

    1. regulation III J.4 of Chapter 1 was amended to enable the Minister for Public Service and Administration to re-determine before 30 June 2001 the format for the annual report for the financial year ending 31 March 2002 after receipt of comments on the format already issued (see par 2 of the Schedule to the Notice); and

    2. corrections were made to regulation I A.1 of Chapter 1, to paragraph 6 of Annexure 1, and in Annexure 2, to clause 1.2.5 of the contract in Part 1, clause 1.1 of the contract in Part 2 and clause 1.1 of the contract in Part 3 (see paragraphs 1, 4 and 5 of the Schedule to the Notice);
