NO. 14 OF 1995: PERIODS OF OFFICE OF MEMBERS OF COUNCILS FOR ARCHITECTS, ENGINEERS, QUANTITY SURVEYORS AND VALUERS ADJUSTMENT ACT, 1995

It is hereby notified that the President has assented to the following Act which is hereby published for general information:-

ACT

To provide for the extension or termination of the periods of office of members ofcouncils established for the professions of architect, engineer, quantity surveyor and valuer; and to provide for matters connected therewith.

BE IT ENACTED by the Parliament of the Republic of South Africa, as follows:-

Definitions

1. In this Act, unless the context indicates otherwise-

(i) "council" means one of the undermentioned bodies:

(a) South African Council for Architects, established by section 2 of the Architects' Act, 1970 (Act No. 35 of 1970);

(b) Engineering Council of South Africa, established by section 2 of the Engineering Profession of South Africa Act, 1990 (Act No. 114 of 1990);

(c) South African Council for Quantity Surveyors, established by section 2 of the Quantity Surveyors' Act, 1970 (Act No. 36 of 1970);

(d) South African Council for Valuers, established by section 2 of the Valuers' Act, 1982 (Act No. 23 of 1982); (iv)

(ii) "member" includes an alternate member; (ii)

(iii) "Minister" means the Minister of Public Works; (iii)

(iv) "period of office" means the period of time for which a person is appointed as a member of a council. (i)

Minister may extend or terminate period of office

2. (1) The Minister may by notice in the Gazette extend or terminate the period of office of the members of a council.

(2) Any extension or termination contemplated in subsection (1) shall apply to all the members of the council concerned.

(3) No termination shall be made under subsection (1) unless members of a new council have been appointed to take over the functions of the council concerned.

Short title

3. This Act shall be called the Periods of Office of Members of Councils for Architects. Engineers, Quantity Surveyors and Valuers Adjustment Act, 1995.
