NO. 45 OF 1994: SOCIAL ASSISTANCE AMENDMENT ACT, 1994.
It is hereby notified that the President has assented to the following Act,
which is hereby published for general informa- tion:

ACT
To amend the Social Assistance Act, 1992, so as to amend a certain
definition; to further regulate the making of grants and financial awards to
certain persons and bodies; and to provide for incidental matters.

BE IT ENACTED by the Parliament of the Republic of South Africa, as follows:-
Amendment of section I of Act 59 of 1992, as amended
by section 14 of Act 118 of 1993
1. Section I of the Social Assistance Act, 1992 (hereinafter referred to as
the principal Act), is hereby amended by the substitution for the definition
of care-dependent child" of the following definition:
" 'care-dependent child' means a child between the ages of one and
eighteen years who requires and receives permanent home care due to his
<<or her>> severe mental or physical disability;".
Amendment of section 2 of Act 59 of 1992, as amended
by section 15 of Act 118 of 1993 and section 3 of Act 180 of 1993
2. Section 2 of the principal Act is hereby amended-
(a) by the substitution for the words preceding paragraph (a) of the
following words:
"2. The Minister **may** <<shall>>, subject to the provisions of this
Act and with the concurrence of the Minister of **State Expenditure**
<<Finance,>> out of moneys appropriated by Parliament for that purpose,
make-"; and
(b) by the substitution for paragraph (g) of the following paragraph:
"(g) a care-dependency grant to a parent <<or foster parent>> in respect
of a care-dependent child.".
Amendment of section 19 of Act 59 of 1992
3. Section 19 of the principal Act is hereby amended by the substitution for
subsection (2) of the following subsection:
"(2) The Minister shall not make any regulation under subsection (1),
except a regulation referred to in paragraphs (a), (d), (f), (i), (j),
(k), (l), (n), (p), (q) and (r) of the said subsection, without the
concurrence of the Minister of **State Expenditure** <<Finance.".>>
Short title and commencement
4. This Act shall be called the Social Assistance Amendment Act, 1994, and
shall come into operation on the date on which the principal Act comes into
operation.
