CRIME PREVENTION AND PUBLIC SAFETY

 Ongoing 
1.1 Contact crimes reduced by 7-10% per annum, with a major focus on social crime prevention, integrated law enforcement operations and the reduction of repeat offendingSAPS, DSD, DOE, DCS, DOJCD, NICOCOngoing2 917 contact crime law enforcement operations were launched. 1.2 Implement Social Crime Prevention Measures   
1.2.1Align development in the 169 priority police station areas with URP and ISDRP, Project Consolidate and informal settlement upgrading. 1.2.5Focus on and improve safety in tourism hotspots SAPS, DEAT, EIE Cluster A task team to manage development of a National Tourism Safety Strategy has been appointed. An external consultant to manage the development of the strategy will be appointed.
1.2.6Present the Socio Graphic Profiles of the 169 priority police stations to provincial and local government authorities for purposes of developing and implementing appropriate developmental projects SAPS, DOJCD, DSD, DCS, EIE & SS ClustersOngoingThe National Technical Team has facilitated the rollout processes in all the provinces. The profiling is in progress in 6 provinces and completed in Gauteng. The team has commenced interfacing with the provinces.
1.2.7Conduct implementation planning workshops with the local and provincial government SAPS, DOJCD, EIE & SS ClustersOngoingA number of integrated plans per priority area have been established and a number of structured relationships have been established with the Planning and Implementation Management Centres. 1.3 Partnerships with Organs of Civil Society and Communities

1.5 Integrated Law Enforcement Operations   
1.5.1Implement the provisions of the Firearms Control Act and sustain interventions to confiscate and destroy illegal firearms SAPSOngoingA total of 1 218 firearms were reported as lost/stolen and 2209 firearms have been recovered. The firearms control amendment Bill has been approved

ORGANISED CRIME SYNDICATES

2.3 Finalise research and a Bill on human traffickingDOJCD, SAPS, NICOC Discussion document on trafficking persons was approved for publication by the Commission in Mar-06. Consultative meetings were held in all the provinces.
2.4 International Cooperation on Crime Combating   
2.4.1International and cross border and regional Operations e.g. Operation Morogoro SAPS, NICOC, NIA , DHAOngoingDuring the cross border operations 90 vehicles were repatriated from SADC countries to SA. 835 vehicles are awaiting repatriation to SA. During operation Palanca Negra 155 stolen vehicles were seized from countries such as Botswana and Zimbabwe
2.4.2Assistance in building capacity in Africa in the field of witness protection DOJCD, SAPS, NPA Sharing SA best practice on witness protection with Africa and International orgs. Uganda, Moz, Namibia, Angola and UN Office on Drugs & Crime have benefited. Senior Prosecutors & SAPS have been trained in witness protection in fighting organised crime

IMPROVING EFFECTIVENESS OF THE CRIMINAL JUSTICE SYSTEM

   
3.1 Enhancing the Capacity of the Cluster Departments   
3.1.1Increase the number of police officers to 152 000 in 2005/06 SAPSApr-06A total of 158 558 posts in the SAPS were filled, 32 993 of these are Public Service Act Personnel. 11 000 posts have been allocated for 2006/7 financial year bringing the staff total to 162 000

3.1.6Continue with the rejuvenation of the SANDF DODOngoingThere are currently 8 392 serving Military Skills Development Systems ((MSDS) members and 3 407 members have been granted Regular Force Service Contracts. The MSDS intake will expand from 7000-10 000. An intake of 4000 is planned for 2007
3.1.7Produce report on state of readiness and effectiveness of disaster management systems and institutions SAPS, DPLG, DODJul-06Various Disaster Management operations were implemented on a provincial level. Policy document on Disaster Management in SA is currently being developed. The counter aircraft hijacking policy was updated
3.1.8Develop capacity to enable the cluster to manage cluster programmes and activities Cluster departments Cluster functioning has been streamlined, giving appropriate authority to conveners of task teams. This includes coordinating with provincial structures and other clusters, rationalising the POA and setting clear goals. Also see 3.2.1 below
3.1.9Develop and implement proposals to improve the capacity of the intelligence agencies, including coordinating mechanisms and systems, to support law enforcement agencies and ensure the security of all citizens NICOC, Presidency,OngoingVarious initiatives are being implemented, and they relate to training; increasing personnel numbers; and investing in other enabling infrastructure.
3.1.10Urgently reactivate National Security Council Presidency National Security Council (NSC) is in operation.
3.2 JCPS Transformation and Modernisation Projects   
3.2.1Establish JCPS coordinating structures at provincial and local government levels SAPS, DOJCD, NPA, DCS, DSD JCPS Coordinating Structures have been established in all 9 provinces. The Free State and the Northern Cape Structures are very active
3.2.2Commence with the review of the Criminal Justice System DOJCD, DCS, SAPS, NPAApril-07An interdepartmental meeting in Aug-06 identified key areas for research and others for review, including bail policy. SAPS and Legal Aid board tasked to engage in bilaterals and give proposals. A project manager for review was appointed. See1.3.1
3.2.3Implement the White Paper on Corrections DCS, DOJCD, DSDOngoingThe development and consultation of policy procedures are in the final stages. The offender rehabilitation part has been developed. Quality Assurance of programmes by service providers to ensure alignment of White Paper objectives has been finalised
3.2.4Implement the Home Affairs National Identification System (HANIS) and the Automated Finger print Identification System (AFIS) DHAOngoing29,2 million paper based finger print records have been digitized. 26,1m paper based finger print records were converted. The record conversion projects have been completed before the targeted end date
3.2.5Enhance the capacity of the Immigration Service DHAOngoingDHA is migrating from its previous staff structure to Turnaround Strategy. Refugee backlog project has processed 20 402 of 90 755 cases. Feasibility study on creating more detention facilities in areas outside Gauteng has been completed

3.3 Implement the Integrated Justice System Programme, including Implementation of video Postponements, Revitalise the Justice College and Implementation of Inmate Tracking systemsDOJCD, SAPS, NPA, DCS,OngoingThe pilot phase in KZN has been extended until such time that the Infrastructural regulatory framework and capacity issues have been dealt with. A total of 3886 cases have been handled through the video remand systems at Sep-06.
3.4 Improve the functioning of our courts   
3.4.1Implement, monitor and evaluate case flow management; establishing local, area and provincial case flow committees; exploring Differentiated Case Flow Management; and rolling out the e-scheduler DOJCD, DCS, NPA, SAPS, DCS, NPA, DHA, DTOngoingNPA delivery plan sets out strategic approach to guide service delivery. A new template has been developed to monitor Case Flow Management. The e-Scheduler was rolled out to 50 Courts
3.4.3Improve the quality of investigations (and time taken to conclude them) and evidence; and improving the management of witnesses DOJCD, DCS, NPA, SAPS, DCS, NPA, DHA, DTOngoingCase investigation is more coordinated. Training of detectives continues as does the management of crime scenes. Appropriate technologies, such as the forensic science laboratory that processes 800 DNA samples per day, also assist investigations.
3.4.4Reduce case cycle times, also giving due attention to children DOJCD, DCS, NPA, SAPS, DCS, NPA, DHA, DTOngoingDuring this financial year 14% of outstanding roll of 1233 are older than 12m in the High Court. 42% of outstanding roll of 47 056 are older than 6m in Regional Courts and 12 % of outstanding roll of 128 868 are older than 2m in District Courts.
3.4.5Reduce number of warrants of arrest for non-appearance DOJCD, NPA, DCS, SAPSOngoingDuring the first quarter of this financial year more warrants have been issued by the courts. There has been a 5.8% increase in the average number of warrants issued from 15 155 warrants per month to 16 041 on average per month
3.5 Person Management   
3.5.1Reduce the number of children in police and prison custody DOJCD, IJS, DCS, DSD, NPAOngoingDCS reported 48807 ATDs in DCS facilities in March 06 of whom 1076 were women and 1138 were children. Children in the DCS facilities per province are as follows: EC 213; GP 232; KZN 346; Lim, MP & NW 50; NC & FS 144; and WC 153
3.5.2Reduce overcrowding of sentenced offenders DCSOngoingMeasures to address the overcrowding of Awaiting Trial Detainees have been implemented
3.5.3Improve rehabilitation of offenders DCSOngoingOperational Agreements were signed with Khulisa Crime prevention initiative and Phaphama initiatives to implement the Drug Peer educator programme.
3.5.4Implement restorative justice, diversion programmes, and alternative dispute resolution DOJCD, DCS, NPA, SAPS, DSD, NPA, DHA, DTOngoingThe target for 2006/7 is set on a total of 41164 cases constituting an average of 3430 cases per month. Lower courts have managed to exceed the target already with 15.5%. 3963 cases were diverted in the first four months.
3.5.5Implement recommendations of the Jali Commission of Inquiry DOJCD, DCS, NPA, SAPS, DSD, NPA, DHA, DTOngoingThere are several findings and recommendations that have been implemented. The Committee is still awaiting the quarterly reports from different branches on the progress made in relation to the disciplinary hearings
3.6 Management of Awaiting Trial Detainees (ATDs)   
3.6.1Improve witness protection programmes DOJCDOngoingNo witnesses or related persons on programme have been reportedly threatened, harmed or assassinated during the reporting period. One witness voluntarily left the programme. The redesign of the Witness Protection Unit (WPU) is ongoing
3.6.2Establish Development Committee task team dealing with Awaiting Trial Detainees DCS, DOJCD, NPA, SAPS, DCS, NPA, DHA, DTOngoingA Development Committee Task Team on Management on ATDs was established in June 2006. KZN reflected a success whereby 18 of the 22 cases referred to court were successful. Awareness Campaigns have been rolled out
3.6.11Conduct audit of foreign nationals in SA correctional facilities and police detention to ascertain that they are not illegal immigrants DCS, DOJCD, NPA, SAPS, DSD, NPA, DHA, DTOngoingThe total number of foreign nationals in the correctional facilities is 4880. 3202 are sentenced and 1678 are unsentenced. There was an increase in the number of foreign nationals due to delays in deportations and their actual place of origin
3.6.12Conduct international research on management of Awaiting Trial Detainees ( ATDs) DCS, DOJCD, NPA, SAPS, DSD, NPA, DHA, DTOngoingSee 3.6.2
3.7 Dedicated Courts   
3.7.1Sustain the dedicated courts, notably, among others, on sexual offences and commercial crimes. Where relevant finalise the framework for the establishment of such courts. DOJCD, NPA, DSD, HealthOngoingA total of 62 Dedicated SO Courts managed to finalise a total 2232 cases with a conviction rate of 63%
3.7.2Sustain the implementation of asset forfeiture NPAOngoingA total of 6 Dedicated SCCU courts managed to finalise a total of 209 cases with a conviction rate of 95%. A total of 47% (562) of their outstanding court roll of 1196 comprised cases older than 6 months
3.8 Secure Care Facilities   
3.8.1Clusters and depts to attend to operational matters, incl definition of department roles and responsibilities, regarding secure care facilities for children in conflict with the law, and the plight of homeless children, as part of social crime prevention JCPS and SS Clusters, DCS, DSD, NPA, SAPS, DOJCD,OngoingISCCJ Task Team discussed the Interim National Protocol on the Management of Children Awaiting Trial, which defines roles and responsibilities of each Dept when a child is arrested or sentenced in all 9 provinces
3.8.2Identify suitable secure care facilities for children in trouble with the law DCS, DSD, NPA, SAPS, DOJCD, NPA, DHA, DTOngoingThe ISCCJ has requested SD. to circulate the numbers of beds available in Secure Care Facilities, contact persons and numbers for identified Secure Care in the provinces. The list has been received and distributed.

UPHOLDING NATIONAL SECURITY

4.2 Border Control and Security

4.2.2Sustain the construction and upgrading of ports of entry, including upgrading of outdated border control technology, with improved satellite and electronic surveillance systems SAPS, DOD, DHA, National Ports Authority, NIA, NICJan-06The DPW is developing a blue print for small, medium and large ports of entry and is developing relevant policies. Several projects are receiving attention in this regard. The pilot projects have been implemented at Lebombo, Maseru and Beit Bridge.
4.2.3Sustain initiatives directed at addressing the illegal movement of persons and goods DHA, SAPS, SARSOngoingEstablishment of the NBCC is a priority. An Implementation Task Team was formed to do investigations needed to capacitate the centre. BCOCC EXCO has approved the way forward on identification of the venue, funding and appointment of dedicated capacity

MATTERS OUTSTANDING FROM TRC

   
5.1 Implement a public awareness programme on the amended prosecutorial guidelines that will regulate outstanding amnesty processes of the TRCDOJCD, DCS, NPA, SAPS, DSD, NPA, DHA, DT Task Teams were established to process the relevant matters
5.2 Establish the relevant institutional mechanisms and systems to coordinate National Prosecuting Authority, law enforcement and intelligence agenciesDOJCD, DCS, NPA, SAPS, DSD, NPA, DHA, DT Policy proposals to give effect to the recommendations of the Khampepe Commission are intended to improve coordination. Other cooperation relates to the Assets Forfeiture Unit, the processing of bail and dealing with organised crime
5.3 Develop policy and operational guidelines on exhumation and reburials of people who had remained unaccounted forDOJCD, DCS, NPA, SAPS, DSD, NPA, DHA, DT The development of policy to guide exhumations and handover ceremonies in respect of identified missing persons is being drafted under the leadership of the DOJCD Minister, in conjunction with SAPS, DAC,DHA , DFA, DSA, SAHRA and NPA.
5.4 Finalise disbursing reparation grants to the victims as defined in the TRC ActDOJCD, DCS, NPA, SAPS, DSD, NPA, DHA, DT 16 837 beneficiaries who have applied for reparations, received a once-off grant of R30 000. 15833 beneficiaries were paid by Jun06. 1411 beneficiaries are unpaid. 692 beneficiaries were untraced and 360 beneficiaries died before they were paid grant.
