The Local Government: Municipal Systems Act, 2000 (Act 32 of 2000) [PDF], established a framework for planning, performance-management systems, effective use of resources and organisational change in a business context.

The Act also established a system for municipalities to report on their performance, and provided residents with an opportunity to compare this performance with that of others.

It also regulates public-private partnerships. The Act allows municipalities significant powers to corporatise their services, establish utilities for service delivery, or to enter into partnerships with other service-providers. The Act provides for the adoption of a credit-control policy for municipalities that will provide for the termination of services in the event of non-payment. Municipalities will have the power to pass bylaws to implement the policy.

The Local Government: Municipal Finance Management Act, 2003 (Act 56 of 2003), [PDF] is aimed at modernising municipal budgeting and financial management. It facilitates the development of a long-term municipal lending/bond market. It also introduces a governance framework for separate entities created by municipalities.

The Act is a critical element in the overall transformation of local government in South Africa. It fosters transparency at local government level through budget and reporting requirements.

The Local Government: Municipal Property Rates Act, 2004 (Act 6 of 2004), [PDF] regulates the power of a municipality to impose property rates, excludes certain properties from rating in the national interest, provides fair and equitable valuation methods of properties, and provides for municipalities to implement a transparent and fair system of exemptions, reductions and rebates through their rating policies. The Act 2004 will be implemented in phases. The Municipal Infrastructure Grant (MIG) is a key instrument for addressing municipal infrastructure and basic service backlogs.
